These Terms of Service ("Terms") govern your use of the websites and products provided by Oded Lipsitz, doing business as TradingXYZ.com ("TradingXYZ", "we", "us"), including TradeLogger (the "Services"). By using the Services, you agree to these Terms.

Not financial advice

TradingXYZ is a software provider, not a broker-dealer, investment adviser, or financial institution. The Services are tools for organizing and analyzing your own trading activity. Nothing in the Services constitutes financial, investment, tax, legal, or trading advice, or a recommendation to buy or sell any security. You are solely responsible for your trading decisions and their outcomes.

Eligibility & accounts

You must be capable of forming a binding contract to use the Services. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Brokerage connections

The Services may let you connect a third-party brokerage account (for example, via the Charles Schwab API) to import your data. Those connections are subject to the broker's own terms and authorization. We are not responsible for the availability, accuracy, or actions of any third-party broker or API, and you authorize us to access your account data solely to provide the Services.

Accuracy of data

We work to reconcile and present your data accurately, but the Services are provided for informational purposes and may contain errors, delays, or omissions. You should verify important figures against your official brokerage statements. Do not rely on the Services as your system of record for tax, regulatory, or accounting purposes.

Acceptable use

  • Do not misuse, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Services.
  • Do not use the Services to violate any law or any third party's rights, including a broker's API terms.

Intellectual property

The Services, including their software, design, and content, are owned by TradingXYZ and protected by applicable law. Your data remains yours; you grant us the limited rights needed to operate the Services for you.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADINGXYZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR TRADING LOSSES ARISING FROM YOUR USE OF THE SERVICES.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or to protect the Services.

Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above; continued use constitutes acceptance.
